C3 Environmental Management zoning in NSW

C3 Environmental Management is the conservation zone that still allows a limited range of development. Its objectives are to protect, manage and restore areas with special ecological, scientific, cultural or aesthetic values, and to provide for a limited range of development that does not have an adverse effect on those values. It was E3 Environmental Management until December 2021.

The Standard Instrument mandates home occupations without consent and dwelling houses, oyster, pond-based and tank-based aquaculture with consent, and requires environmental protection works and roads to be permitted. It prohibits industries, local distribution premises, multi dwelling housing, residential flat buildings, retail premises, seniors housing, service stations, warehouse or distribution centres and any other development not specified in item 2 or 3. A note allows, but does not require, home industries, kiosks, cellar door premises, neighbourhood shops and roadside stalls to be permitted with consent.

Zone C3 Environmental Management

Land with special environmental values where a limited range of development, including a dwelling house, can be considered if it does not harm those values.

  1. To protect, manage and restore areas with special ecological, scientific, cultural or aesthetic values.

Direction: Home industries, kiosks, cellar door premises, neighbourhood shops and roadside stalls may, but need not be, permitted with development consent.

A council LEP adopts this entry and adds its own objectives, permitted uses and prohibited uses under the Land Use Table directions, so the LEP land use table for the land is the one that applies. Schedule 1 of the LEP, the Housing SEPP and the Codes SEPP can permit development the table does not.

Dwelling houses

Mandated with consent, which is the clearest difference from C2. A minimum lot size and, in most C3 LEPs, a dwelling entitlement clause apply, and the lot sizes are typically rural in scale. The Codes SEPP's Rural Housing Code does not list C3 among its zones, so a new dwelling usually needs a development application.

Secondary dwellings and dual occupancies

Neither is mandated. C3 is not a residential zone under section 49 of the Housing SEPP, so its secondary dwelling provisions do not apply, and multi dwelling housing and residential flat buildings are prohibited outright. A dual occupancy in C3 depends on the council's LEP, and many prohibit it.

Small-scale rural and tourist uses

The Standard Instrument's note allows councils to permit home industries, kiosks, cellar door premises, neighbourhood shops and roadside stalls. Eco-tourist facilities, farm stay accommodation and extensive agriculture are also common LEP additions.

Vegetation and hazards

C3 land is frequently bush fire prone or flood affected, and the Biodiversity Conservation Act 2016 and Local Land Services Act 2013 regulate clearing regardless of what the LEP permits.

Former zone names

C3 was zone E3 Environmental Management until 1 December 2021, when the environmental zones were renamed C1 to C4 so that E could be reused for the employment zones. Clause 3 of Schedule 1 of the Standard Instrument treats references to the old E3 as including C3; the zone's content was not changed. The current E3 Productivity Support zone is an unrelated employment zone.

What does C3 Environmental Management zoning mean?

Can I build a house on C3 land?

Dwelling houses are permitted with consent in every C3 LEP, subject to the Lot Size Map minimum and any dwelling entitlement clause, and to site constraints such as bush fire and biodiversity. A development application is normally required because the Rural Housing Code does not cover C3.

Can I build a granny flat on C3 land?

Not through the Housing SEPP, whose secondary dwelling provisions apply to residential zones R1 to R5. A secondary dwelling in C3 is permissible only where the council's LEP lists it.

What is the difference between C3 and C4?

Both mandate dwelling houses with consent. C3's purpose is protecting land with special values while allowing limited development; C4 Environmental Living's purpose is low-impact residential development in such areas. C3 prohibits multi dwelling housing, residential flat buildings, retail premises and seniors housing expressly; C4's prohibition list is shorter.

Is E3 zoning the same as C3?

The old E3 Environmental Management zone is now C3, and Schedule 1 of the Standard Instrument treats references to it as including C3. The new E3 Productivity Support zone, created in 2023, is an employment zone and has nothing to do with C3.
