R4 High Density Residential zoning in NSW

R4 High Density Residential is the apartment zone. Its objectives ask for housing within a high density residential environment, and the Standard Instrument mandates residential flat buildings and shop top housing with consent alongside boarding houses, community facilities, child care, places of public worship and neighbourhood shops.

The Standard Instrument's R4 list is deliberately short on lower-density housing. Dwelling houses, dual occupancies, multi dwelling housing and attached dwellings are not mandated, so whether an existing house in R4 can be rebuilt as a house, rather than redeveloped, depends entirely on the council's LEP land use table.

A council LEP adopts this entry and adds its own objectives, permitted uses and prohibited uses under the Land Use Table directions, so the LEP land use table for the land is the one that applies. Schedule 1 of the LEP, the Housing SEPP and the Codes SEPP can permit development the table does not.

Residential flat buildings

Mandated with consent, so every R4 LEP permits them. The height of buildings and floor space ratio maps set the envelope, and Chapter 4 of State Environmental Planning Policy (Housing) 2021 applies its design requirements, including the Apartment Design Guide, to residential apartment development. Within low and mid rise housing areas, sections 175 and 176 of the Housing SEPP set minimum height and storey standards in R4.

Shop top housing

Also mandated with consent. Direction 7 of the Land Use Table requires an LEP to permit at least one type of commercial premises or health services facilities wherever shop top housing is permitted, so a ground-floor shop under R4 apartments is always possible in principle.

Houses, duplexes and townhouses

None are in the Standard Instrument list for R4. Councils vary: some permit dwelling houses and multi dwelling housing in R4 so that existing streets can renew gradually, others do not. A secondary dwelling under section 52 of the Housing SEPP is only available where a dwelling house is itself permissible.

Site amalgamation

R4 sites are often too small to carry a flat building on their own, and DCPs commonly set minimum frontages or site areas for flat buildings. Clause 4.5 of the Standard Instrument counts contiguous lots in a single development as one site area for floor space ratio purposes.

What can you build on R4 zoned land in NSW?

Residential flat buildings, shop top housing, boarding houses, community facilities, centre-based child care facilities, respite day care centres, places of public worship and neighbourhood shops are mandated with consent in every R4 LEP. Dwelling houses, dual occupancies and townhouses are permitted only where the council's LEP adds them.

Can I keep or rebuild a single house on R4 land?

An existing lawful house keeps its existing use rights, but building a new dwelling house in R4 is permissible only if the council's LEP lists dwelling houses in the R4 land use table. The Standard Instrument does not mandate them.

How tall can an R4 building be?

The zone does not say. Height comes from the Height of Buildings Map and clause 4.3 of the LEP, and in low and mid rise housing areas the Housing SEPP sets its own minimum standards in R4. Use the zoning explainer's height chip for the mapped figure and read the clause behind it.

Is R4 the same as a mixed use zone?

No. R4 is residential; commercial uses are limited to shop top housing's ground floor, neighbourhood shops and the like. MU1 Mixed Use mandates commercial premises, light industries and function centres alongside shop top housing.
