E3 Productivity Support zoning in NSW

E3 Productivity Support is the zone for the businesses that support a centre without competing with it: light industries, warehouses, offices, bulky-goods retail, trade suppliers, vehicle workshops and the services that go with them. Its six objectives include providing land uses compatible with but not competing with surrounding centres, maintaining the viability of those centres by limiting certain retail and commercial activity, and enabling businesses to sell goods of a large size, weight or quantity or goods manufactured on-site.

E3 has the longest mandatory list in the Standard Instrument, more than forty uses with consent, from animal boarding establishments and boat building through hardware and building supplies, light industries, office premises and specialised retail premises to warehouse or distribution centres and wholesale supplies. It replaced B5 Business Development, B6 Enterprise Corridor and B7 Business Park in April 2023.

Zone E3 Productivity Support

Light industry, warehouses, offices, bulky-goods retail and services that support the centres nearby without competing with them.

  1. To provide a range of facilities and services, light industries, warehouses and offices.
  2. To provide for land uses that are compatible with, but do not compete with, land uses in surrounding local and commercial centres.
  3. To maintain the economic viability of local and commercial centres by limiting certain retail and commercial activity.
  4. To provide for land uses that meet the needs of the community, businesses and industries but that are not suited to locations in other employment zones.
  5. To provide opportunities for new and emerging light industries.
  6. To enable other land uses that provide facilities and services to meet the day to day needs of workers, to sell goods of a large size, weight or quantity or to sell goods manufactured on-site.

A council LEP adopts this entry and adds its own objectives, permitted uses and prohibited uses under the Land Use Table directions, so the LEP land use table for the land is the one that applies. Schedule 1 of the LEP, the Housing SEPP and the Codes SEPP can permit development the table does not.

Light industry and warehouses

Light industries, warehouse or distribution centres, storage premises, depots and local distribution premises are all mandated with consent. General industries are not; they belong to E4.

Bulky goods and trade retail

Specialised retail premises (bulky goods), hardware and building supplies, garden centres, landscaping material supplies, rural supplies, timber yards, vehicle sales or hire premises and industrial retail outlets are mandated. Ordinary shops are not: the third objective limits retail that would compete with centres, so a supermarket in E3 depends on the LEP and is often excluded.

Offices

Office premises and business premises are mandated with consent, which is what carried the old B7 Business Park land into E3. Commercial premises as a whole is not on the list, so retail premises other than the specified kinds depend on the LEP.

Housing

No residential use is mandated in E3 other than home industries, and most councils prohibit dwellings here. Caretakers' residences are an optional addition.

Former zone names

Before 26 April 2023 this land was generally zoned B5 Business Development, B6 Enterprise Corridor or B7 Business Park. Schedule 1 of the Standard Instrument names each as a former zone and E3 as a new zone. The translation of those three zones to E3 follows the Department of Planning's employment zone reform guidance rather than the Standard Instrument, and councils were able to put individual sites into other zones. The savings period for former-zone permissibility ended on 26 April 2025.

Can I open a shop in E3?

Only certain kinds. Specialised retail premises, hardware and building supplies, garden centres, industrial retail outlets, neighbourhood shops and take away food and drink premises are mandated with consent. General retail premises such as a supermarket or clothing shop are not mandated, and an E3 objective is to limit retail that competes with centres, so check the LEP table.

Can I build housing on E3 land?

The Standard Instrument mandates no dwellings in E3 beyond home industries. Housing is permissible only where the council's LEP adds it, and most E3 tables prohibit residential accommodation.

Is E3 an industrial zone?

It is an employment zone that includes light industry but not general or heavy industry. General industries are mandated in E4 General Industrial and heavy industries in E5 Heavy Industrial.
