R2 Low Density Residential zoning in NSW

R2 Low Density Residential is the zone most NSW suburban houses sit in. Its first objective is housing within a low density residential environment, and the Standard Instrument mandates only a short list of uses with consent: dwelling houses, group homes, centre-based child care facilities, respite day care centres and three forms of aquaculture. Home occupations must be permitted without consent.

Everything denser than a single house, from a dual occupancy to a residential flat building, is either something the council chose to add to its LEP land use table or something the Housing SEPP permits over the top of the LEP. That is why two R2 lots in neighbouring council areas can have very different development options.

What the Standard Instrument says

Zone R2 Low Density Residential

The detached-house zone. Housing is kept low density, and the only other uses are ones that serve residents' day-to-day needs.

A council LEP adopts this entry and adds its own objectives, permitted uses and prohibited uses under the Land Use Table directions, so the LEP land use table for the land is the one that applies. Schedule 1 of the LEP, the Housing SEPP and the Codes SEPP can permit development the table does not.

Dwelling houses

A dwelling house is permitted with consent in every R2 LEP. A new one- or two-storey house can also be complying development under the Housing Code in Part 3 of the Codes SEPP where the lot and design meet its standards, which avoids a development application but not the exclusions in clause 1.19.

Granny flats (secondary dwellings)

The Standard Instrument does not list secondary dwellings for R2, but Chapter 3 of the Housing SEPP does. Section 52 permits a secondary dwelling with consent in a residential zone where a dwelling house is permissible, capped at 60 m² or the larger area another instrument allows, and section 54 makes it complying development on lots of at least 450 m². Clause 2.6(2) of the Standard Instrument stops the two dwellings being subdivided onto separate lots unless both meet the Lot Size Map minimum.

Dual occupancies, semis, terraces and manor houses

None of these are mandated for R2, so most depend on the council's LEP table. The Housing SEPP's low and mid rise housing chapter changes that within 400 m or 800 m of listed town centres and stations: section 166 permits dual occupancies and semi-detached dwellings with consent in R2 there, section 170 permits multi dwelling housing and attached dwellings, and section 174 permits residential flat buildings, subject to the exclusions in section 164 for bush fire, flood, heritage and listed areas.

Subdivision

Subdivision in R2 needs consent under clause 2.6 and must meet the Lot Size Map minimum, which for many suburban councils sits between 450 m² and 700 m². Section 169 of the Housing SEPP lets a dual occupancy approved on or after 28 February 2025 be split into lots of at least 225 m² with 6 m frontage where the chapter applies.

What does R2 zoning mean in NSW?

R2 Low Density Residential is the Standard Instrument zone for detached housing. What can you build on R2 zoned land in NSW?

A dwelling house, with consent or as complying development under the Housing Code. A secondary dwelling under the Housing SEPP. Beyond that it depends on the council's LEP land use table: many R2 LEPs permit dual occupancies and some permit multi dwelling housing, while others keep R2 to single houses. Within the Housing SEPP's low and mid rise housing areas, dual occupancies, terraces and residential flat buildings are permitted in R2 whatever the LEP says, subject to the section 164 exclusions.

Can I build a duplex on R2 land?

Only if the council's LEP lists dual occupancy as permitted with consent in R2, or the site is in a low and mid rise housing area under section 163 of the Housing SEPP, where section 166 permits it. Where it is permitted, section 168 sets non-discretionary standards (450 m² lot, 12 m width, 0.65:1 floor space ratio, 9.5 m height) that a consent authority cannot use as a reason for refusal, and the Low Rise Housing Diversity Code can make a one- or two-storey dual occupancy complying development.

Is a granny flat allowed in R2?

Yes, through the Housing SEPP rather than the zone. Section 50 applies the secondary dwelling provisions in any residential zone where a dwelling house is permissible, so an R2 lot with a house can have a secondary dwelling with consent, or as complying development on a lot of at least 450 m² under section 54.

Can R2 land be subdivided?

With consent, and only into lots that meet the minimum on the LEP's Lot Size Map, unless a clause in the LEP or the Housing SEPP's section 169 dual occupancy subdivision provision applies. Strata subdivision of an approved building can be complying development under Part 6 of the Codes SEPP.
