C4 Environmental Living zoning in NSW

C4 Environmental Living is the conservation zone for housing. Its objectives are to provide for low-impact residential development in areas with special ecological, scientific or aesthetic values and to ensure that residential development does not have an adverse effect on those values. Councils use it for bushland suburbs, escarpments, ridgelines and river frontages where houses exist but density and clearing need to be held down. It was E4 Environmental Living until December 2021.

The Standard Instrument mandates home occupations without consent and dwelling houses, oyster, pond-based and tank-based aquaculture with consent, requires environmental protection works and roads to be permitted, and prohibits industries, local distribution premises, service stations, warehouse or distribution centres and any other development not specified in item 2 or 3. A note allows home industries to be permitted with consent.

Zone C4 Environmental Living

Low-impact residential living in bushland or scenic areas. Dwelling houses are in the mandated list, but denser housing and industry are prohibited.

Direction: Home industries may, but need not be, permitted with development consent.

A council LEP adopts this entry and adds its own objectives, permitted uses and prohibited uses under the Land Use Table directions, so the LEP land use table for the land is the one that applies. Schedule 1 of the LEP, the Housing SEPP and the Codes SEPP can permit development the table does not.

Dwelling houses

Mandated with consent, and the reason the zone exists. C4 lots are usually larger than R2 lots and the DCP often adds site coverage, tree retention and building envelope controls. C4 is not a Housing Code zone, so a new house normally needs a development application.

Secondary dwellings and dual occupancies

Neither is mandated. C4 is a conservation zone, not a residential zone under section 49 of the Housing SEPP, so its secondary dwelling provisions do not apply. Some councils permit secondary dwellings or dual occupancies in C4 with consent; others prohibit them to hold the low-impact objective. The LEP table decides.

Multi dwelling housing and apartments

Unlike C3, the Standard Instrument's C4 entry does not name multi dwelling housing or residential flat buildings expressly, but its residual clause prohibits any use the LEP does not list, and councils almost never list them in C4.

Subdivision

Consent is required and the Lot Size Map minimum applies. C4 minimums are commonly larger than the surrounding residential zones, and many LEPs add a clause restricting subdivision that would increase dwelling numbers in environmentally sensitive land.

Former zone names

C4 was zone E4 Environmental Living until 1 December 2021, when the environmental zones became C1 to C4 so that E could be reused for the employment zones. Clause 3 of Schedule 1 of the Standard Instrument treats references to the old E4 as including C4; the zone's content did not change. The current E4 General Industrial zone is an unrelated employment zone.

Can I build a house on C4 land?

Complying development under the Housing Code is not available in C4, so a development application is the normal path.

Can I build a granny flat or duplex on C4 land?

Only where the council's LEP permits secondary dwellings or dual occupancies in C4. The Housing SEPP's secondary dwelling provisions apply to residential zones and not to C4, and the Standard Instrument mandates neither use.

Is E4 zoning the same as C4?

The old E4 Environmental Living zone is now C4, and Schedule 1 of the Standard Instrument treats references to it as including C4. The new E4 General Industrial zone created in 2023 is an employment zone and unrelated.
