RU5 Village zoning in NSW

RU5 Village is the zone for small rural towns and villages that do not need separate residential, business and community zones. Its single objective is to provide for a range of land uses, services and facilities associated with a rural village, and its mandatory with-consent list reflects that: dwelling houses, neighbourhood shops, community facilities, centre-based child care, places of public worship, recreation areas and facilities, schools and respite day care centres, with home occupations permitted without consent.

Because RU5 is a whole-town zone, the council's LEP land use table matters more than in most zones. Commercial premises, dual occupancies, multi dwelling housing, industry and tourist accommodation are all optional additions, and councils differ widely.

A council LEP adopts this entry and adds its own objectives, permitted uses and prohibited uses under the Land Use Table directions, so the LEP land use table for the land is the one that applies. Schedule 1 of the LEP, the Housing SEPP and the Codes SEPP can permit development the table does not.

Housing

Dwelling houses are permitted with consent in every RU5 LEP. Dual occupancies and multi dwelling housing are optional. RU5 is not a residential zone under section 49 of the Housing SEPP, so its secondary dwelling provisions do not apply and a granny flat depends on the LEP. The Housing Code and the Low Rise Housing Diversity Code in the Codes SEPP can apply in RU5 where the LEP permits the use.

Shops and businesses

Neighbourhood shops are mandated. Larger retail, business premises, office premises and pubs are optional and typically added because there is no separate business zone in the village.

Schools and community uses

Schools, places of public worship and community facilities are mandated with consent, and Chapter 3 of State Environmental Planning Policy (Transport and Infrastructure) 2021 adds further permissibility for educational establishments.

Subdivision

Consent is required and the Lot Size Map minimum applies. Village minimums are often around residential sizes where sewer is available and larger where it is not.

What is RU5 Village zoning?

RU5 is the Standard Instrument zone for rural villages. It bundles the housing, shops, community facilities and services a small town needs into one zone, with dwelling houses, neighbourhood shops, schools and community facilities all mandated with consent.

Can I build a house in an RU5 village?

Yes, with consent, in every RU5 LEP. A new one- or two-storey house can also be complying development under the Housing Code where the lot meets its standards and no exclusion in clause 1.19 of the Codes SEPP applies.

Can I open a shop in RU5?

A neighbourhood shop is mandated with consent. Larger shops, business premises and other commercial premises are permissible only where the council's LEP adds them, which most village LEPs do to some degree.

Does the Housing SEPP granny flat rule apply in RU5?

No. Section 49 of the Housing SEPP defines residential zone as R1 to R5 or an equivalent zone, and RU5 is a rural zone. A secondary dwelling in RU5 needs to be permitted by the council's LEP land use table.
